TERMS OF SERVICE

These Terms and Conditions set out the basis on which Nap York (as defined below) will provide accommodation and other products and services to Guests (as defined below). By making a Booking (as defined below) the Guest agrees to comply with these Conditions.

1. INTERPRETATION

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

"Arrival Date" means the date on which the Guest’s stay at the hostel is due to commence, as per the Booking Details.

"Booking" means the reservation by the Guest of accommodation and any other products and services detailed in the Booking which is accepted by Nap York.

“Booking Details” means the details of the Booking including the number of Guests, the number of rooms required, the duration of the Guests stay at the Sleep Station and any other products and/or services to be included in the Booking.

“Charges” means the charges payable by the Guest in connection with the Booking.

“Contract” means the contract between the Guest and Nap York in relation to the Booking.

“Guests” means the person who makes the Booking.

“Sleep Station” means the building owned or operated by Nap York the location of which is specified in the Booking.

“Overnight Reservation” means the booking of a service, facility, or property on a nightly basis from 4 PM on the Check-in date to 10 AM on the Check-out date. 

Hourly Reservation” means the booking of a service, facility, or property for a specified number of hours.

2. BOOKINGS

2.1 Guests can request Bookings via Nap York’s website or by contacting reserve@napyork.com

2.2 When requesting Bookings, Guests will be required to provide identification information including, but not limited to, their name, address, contact telephone number and email address.

2.3 No request for a Booking should be deemed to be accepted unless and until Nap York confirms its acceptance and provides a booking reference, at which point the Contract will come into existence.

2.4 All reservations are required to be made in advance. Guests who do not have a reservation will not be let in by security, and walk-ins will not be accepted.

2.5 Nap York will use its reasonable endeavors to accommodate any request from the Guest to change the Booking Details, but any request to change the dates or length of stay or add products and/or services will be subject to availability and may incur a fee. The fee amount will be communicated to the Guest at the time of the request. Any difference in rates between the original and new reservation dates will also be applied.

2.5.1 Multiple changes to reservation may incur additional fees and are subject to approval. We reserve the right to limit the number of changes permitted per reservation.

2.5.2 For reservations labeled as non-refundable or with special conditions, changes may not be permitted, or may incur significant fees, as specified in the original booking terms.

2.6 Nap York will not accept reservations for stays exceeding 14 consecutive days per calendar quarter. We reserve the right to cancel any reservation that violates this policy, either before or during the stay, without notice or liability.

2.6.1 If a guest wishes to make additional bookings after reaching the 14-day limit within a quarter, they must wait until the following quarter to book again.

2.6.2 Guests are permitted to extend their reservation up to three (3) times; however, the total stay must not exceed the 14-day limit in any quarter.

2.7 When booking beds in a shared room, Nap York will attempt to put people on the same booking in the same room, however this cannot be guaranteed

3. FEES AND PAYMENT

3.1 The Charges will be as quoted by Nap York to the Guest upon the Guest’s request for a Booking.

3.2 All prices are subject to additional State and City taxes.

3.3 Unless otherwise agreed by Nap York, the Charges only cover the provision of accommodation at the Sleep Station.

3.4 Guests will be informed of the amount of the Additional Charges before they are incurred.

3.5 Guests must provide a valid Debit or Credit Card details via which payment of the Charges or the balance of the Charges (as the case may be) and any Additional Charges can be taken at the time of booking.

3.6 If not prepaid in full at time of booking the balance of the Charges will be charged automatically by Nap York 5 days before arrival, with the card used when making the reservation. Any Additional Charges must be paid either as they are incurred or, at Nap York’s option, upon the Guest checking out at the Sleep Station.

3.7 Nap York reserves the right to pre-authorize credit cards without any written approval from the Guest.

3.8 By booking with Nap York, Guests authorize Nap York to place a hold on their payment method for the amount of the damage deposit. This hold will be placed at the time of check-in and will be released after check-out, subject to the conditions outlined below:

3.8.1 The damage deposit hold serves as security for any damages, excessive cleaning charges, or other liabilities incurred during Guests stay. If any such costs arise, the corresponding amount will be deducted from the hold.

3.8.2 If no damages, excessive cleaning, or other charges are identified, the hold on the Guest’s payment method will be released within 7 business days after check-out. The exact time frame for the release may vary depending on the financial institution.

3.8.3 If any deductions are made from the damage deposit hold, Guests will be notified in writing, with an itemized list of the charges and the reasons for them.

3.8.4 If the damage or charges exceed the amount of the hold, Guest will be responsible for paying the additional amount. Failure to settle these charges may result in further action, including legal proceedings.

3.9 The following payment methods are accepted by Nap York

3.9.1 Credit and Debit Cards

American Express, Visa and Mastercard

3.10 Nap York does not accept cash and does not offer cash refunds. Any account credits are at our discretion.

4. CANCELLATIONS

4.1 Overnight Reservations Cancellation Policy:

4.1.1 Non-refundable reservation: Non-refundable

4.1.2 Refundable/Standard/Flexible reservation: Full refund if cancelled 5 days before arrival.

4.2 Hourly Reservation Cancellation Policy:

4.2.1 Cancellations done 2 hours before check-in time will get a full refund. Cancellations done within 2 hours of check-in time or after will not be refunded.

4.3 Where the Guest has been offered a discounted rate on condition that the Booking becomes non-refundable upon cancellation then, provided the Guest has been informed of such Condition, in the event of cancellation or modification of the Booking, all Charges applicable to that Booking remain payable in full.

4.4 If the Guest fails to give sufficient notice of cancellation or fails to arrive (no show) at Nap York, the entire Booking will be deemed cancelled and the Guest will have to pay the full amount of the stay.

4.5 Nap York may at any time cancel a Booking if the room becomes unavailable due to circumstances outside Nap York’s control in which case Nap York will offer the Guest the option to rebook for the future at no additional charge.

4.6 Nap York may at any time cancel the Booking if the payment details provided by the Guest are invalid and the Guest fails to provide alternative valid details.

5. CHECK IN AND CHECK OUT

5.1 The standard check-in time for Overnight Reservations is 4:00 PM local time. Guests are expected to arrive at the premises no earlier than this time. Early check-in must be requested and approved at least 24 hours before Guest’s scheduled check-in time. Early check-ins are subject to availability and may incur additional charges, which will be communicated at the time of request.

5.2 The standard check-out time for Overnight Reservations is 10:00 AM local time. Guests are required to vacate the premises by this time. A grace period of 30 minutes may be granted beyond the check-out time at our discretion. After this period, additional charges will apply.

5.2.1 Later check-out times may be possible by prior arrangement with an additional charge and subject to availability. In the absence of such prior arrangement, failure to check-out by 10:00 AM may result in the Guest being charged for an additional night’s accommodation at the standard applicable rate.

5.3 The standard check-in time for Hourly Reservations is the start of the reserved hourly period. Guests are expected to arrive at the premises promptly at this time. Building security will not let the Guest in before their reservation time. If the Guest does not check in within the first hour of their reserved time and have not notified us of any delays, the reservation may be considered a no-show, and the reservation may be forfeited without a refund.

5.4 The standard check-out time for hourly reservations is at the end of the reserved hourly period. Guests are expected to vacate the premises by this time to avoid additional charges. A grace period of 15 minutes may be granted beyond the check-out time at our discretion. After this period, additional charges will apply.

5.4.1 Any occupancy beyond the reserved time without prior approval will result in additional charges, which may include: An hourly rate for each hour or portion thereof, or a potential surcharge if the overstay disrupts subsequent reservations.

5.5 Guests are required to follow all check-out procedures, including returning towels, access cards, and any other items provided. Failure to comply may result in additional charges.

6. SLEEP STATION RULES

6.1 Guests are required to present valid identification in the form of a Driver License or Passport upon check-in. Failure to provide the necessary documents may result in denied access to the premises.

6.2 Quiet hours are in effect 24 hours a day, 7 days a week. Guests are expected to maintain a low noise level at all times to ensure a peaceful environment for all. Activities that generate excessive noise, such as loud music, shouting, or any other disruptive behavior, are strictly prohibited at all times. This applies to both indoor and outdoor areas of the premises. Non-compliance with the quiet hours policy may result in immediate action, including but not limited to, warnings, fines, and possible termination of the reservation without a refund.

6.3 Smoking and the use of illegal drugs are strictly prohibited on the premises. This includes, but is not limited to, all indoor areas, outdoor areas, balconies, and common spaces. Violations of the no smoking or drug use policy may result in immediate action, including but not limited to, fines, eviction from the premises, and forfeiture of any security deposit or payments made. Cleaning fees may also be applied to remove smoke or drug odors from the premises.

6.4 Guests are required to conduct themselves in a reasonable and responsible manner at Nap York and must not act in any way which may disturb other guests.

6.5 Nap York does not accept bookings made by those under the age of 18. Failure to adhere to this rule will result in automatic Cancellation with no refund given.

6.6 Beds are strictly single occupancy. The reserved accommodation is intended for use by one individual, and no additional guests are permitted. Any attempt to accommodate additional guests without prior authorization may may result in immediate action, including but not limited to, fines, eviction from the premises, and forfeiture of any security deposit or payments made.

7. FOOD AND DRINK

7.1 Unless otherwise agreed by Nap York, the Charges do not include any food or drink. 

7.2 Storing or consuming food inside the room is strictly prohibited. This rule applies to all types of food and beverages, except for water. Guests are required to consume all food and beverages in designated eating areas provided by the property. Information about these areas will be provided upon check-in.

8. DISABLED GUESTS

8.1 Nap York complies with all laws regulating the treatment of, and provision for, disabled Guests.

8.2 Customers with any special requirements pertaining to a disability should inform the management team prior to the Arrival Date by contacting reserve@napyork.com.

9. Nap York’S LIABILITY

9.1 Nothing in these Conditions purports to limit or exclude the Nap York’s liability for:

(a) death or personal injury caused by the negligence of Nap York its employees, subcontractors or agents;

(b) fraud or fraudulent misrepresentation; or

(c) any other matter for which it would be illegal for the Sleep Station to limit or exclude its liability.

9.2 If Nap York breaches these Conditions or is negligent, it is responsible for the loss of damage suffered by the Guest that is a foreseeable result of the breach of negligence but are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Nap York’s breach of these Conditions or if they were contemplated by Nap York and the Guest when they entered into the Contract.

9.3 The Guest agrees that Nap York is only supplying its facilities, products and services to the Guest for private use and have no liability to the Guest for any loss of profit, loss of business, business interruption or loss of business opportunity.

10. PERSONAL DATA

10.1 Nap York’s treatment of Guests data follows the US General Data Protection Regulations.

10.2 The Guest hereby consents to Nap York collecting of the Guests personal data such as name, surname, email address, social security number, phone number, address, contact information, details of the bank account number and IP number.

10.3 The personal data is used by Nap York for the performance of the Contract, for marketing and as a basis for statistics and for Nap York’s product development. Nap York has the right to share your personal data with its partners for advertisement and promotion.

10.4 The personal data may be analyzed and grouped for the selection, prioritization and planning of the marketing of Nap York, so-called profiling.

10.5 As a Guest of Nap York, you agree to receive marketing information via mail, telephone, or e-mail and text messages, and other digital channels.

10.6 Personal information is disclosed to US authorities only when it is required by law or official order.

11. GENERAL

11.1 The Guest’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Conditions.

11.2 Nap York may transfer its rights and obligations under the Contract to another organization but will always inform the Guest if this happens and this will not affect the Guest’s rights under the contract.

11.3 Nap York will not be liable to the Guest for any failure to perform or delaying in performing its obligations where such failure or delay is due to an event outside Nap York’s control (including without limitation, extreme adverse weather, industrial action, or natural disaster). If such an event prevents Nap York from fulfilling the Booking, either party may cancel the Contract.

11.4 Nap York may, from time to time, change these Conditions without notice. However, the version of these Conditions in force at the time of the Booking will continue to apply to the Contract. Guests are advised to check Nap York’s website for the latest version of these Conditions before making a Booking.

11.6 No failure by Nap York to enforce these Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.

11.7 If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.

11.8 These Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of New York State will have jurisdiction to deal with any disputes (including in relation to non-contractual matters) arising in connection with it.

11.9 No person who is not a party to the Contract will have any rights in connection with it.

12. PROHIBITION OF ADDRESS CHANGE TO HOTEL PREMISES

12.1 Guests are prohibited from using Nap York’s address as their personal or business address for any official or legal purposes. Nap York does not permit the use of its address for the registration of personal identification documents, mail correspondence, or any official purposes. Any breach of this condition may result in the cancellation of the booking, and guests may be required to vacate the premises immediately. Nap York reserves the right to refuse delivery of mail or packages addressed to guests in violation of this clause.

13. GROUP BOOKINGS

13.1 Booking of 4 people or more will be considered as group bookings.

By making a reservation, Guests acknowledge and agree to adhere to all clauses outlined above.
