TERMS OF SERVICE
These Terms and Conditions set out the basis on which Nap York (as defined below) will provide accommodation and other products and services to Guests (as defined below). By booking a stay at Nap York, guests agree to comply with these terms and conditions. Nap York reserves the right to amend these terms without prior notice.
1. INTERPRETATION
In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
"Arrival Date" or “Check-In” means the date on which the Guest’s stay at Nap York is due to commence, as per the Booking Details.
"Departure Date" or “Check-Out” means the date on which the Guest’s stay at Nap York is due to conclude, as per the Booking Details.
"Booking" means the reservation by the Guest of accommodation and any other products and services detailed in the Booking which is accepted by Nap York.
“Booking Details” means the details of the Booking including the number of Guests, the number of rooms required, the duration of the Guests stay at the Sleep Station and any other products and/or services to be included in the Booking.
“Charges” means the charges payable by the Guest in connection with the Booking.
“Contract” means the contract between the Guest and Nap York in relation to the Booking.
“Guests” means the person who makes the Booking.
“Sleep Station” means the building owned or operated by Nap York the location of which is specified in the Booking.
“Nightly Reservation” means the booking of a service, facility, or property on a nightly basis from 3 PM on the Check-in date to 10 AM on the Check-out date.
Hourly Reservation” means the booking of a service, facility, or property for a specified number of hours.
2. BOOKINGS
2.1 Guests can request Bookings via Nap York’s website or by contacting reserve@napyork.com
2.2 When requesting Bookings, Guests will be required to provide identification information including, but not limited to, their name, address, contact telephone number and email address.
2.3 No request for a Booking should be deemed to be accepted unless and until Nap York confirms its acceptance and provides a booking reference, at which point the Contract will come into existence.
2.4 All reservations are required to be made in advance. Guests who do not have a reservation will not be let in by security, and walk-ins will not be accepted.
2.5 Nap York will use its reasonable endeavors to accommodate any request from the Guest to change the Booking Details, but any request to change the dates or length of stay or add products and/or services will be subject to availability and may incur a fee. The fee amount will be communicated to the Guest at the time of the request. Any difference in rates between the original and new reservation dates will also be applied.
2.5.1 Multiple changes to reservation may incur additional fees and are subject to approval. We reserve the right to limit the number of changes permitted per reservation.
2.5.2 For reservations labeled as non-refundable or with special conditions, changes may not be permitted, or may incur significant fees, as specified in the original booking terms.
2.6 Nap York will not accept reservations for stays exceeding 14 consecutive days per calendar quarter. We reserve the right to cancel any reservation that violates this policy, either before or during the stay, without notice or liability.
2.6.1 If a guest wishes to make additional bookings after reaching the 14-day limit within a quarter, they must wait until the following quarter to book again.
2.6.2 Guests are permitted to extend their reservation up to three (3) times; however, the total stay must not exceed the 14-day limit in any quarter.
2.7 When booking beds in a shared room, Nap York will attempt to put people on the same booking in the same room, however this cannot be guaranteed.
2.8 A group booking is defined as a reservation made for 4 or more individuals traveling together or as part of a coordinated group.
2.8.1 Group bookings must be requested directly with Nap York via e-mail to ensure proper coordination and availability.
2.8.2 A designated group leader or organizer must be identified as the primary contact person for all communications and arrangements.
2.8.3 Room or pod allocations will be determined based on availability and group size. Special requests for adjacent accommodations or specific arrangements must be made in advance and are subject to availability.
2.8.4 The group organizer is responsible for ensuring all group members adhere to Nap York’s rules and policies. Disruptive behavior by any group member may result in the termination of the reservation for the entire group without a refund.
2.8.5 Payments for group bookings must be made in a single transaction unless otherwise agreed upon.
2.8.6 Group bookings may qualify for discounted rates. Discounted group rates will be communicated during the reservation process and are subject to Nap York’s terms and conditions.
3. FEES AND PAYMENT
3.1 Guests must provide valid Debit or Credit Card details at the time of booking to secure their reservation.
3.2 The following payment methods are accepted by Nap York:
Credit and Debit Cards: American Express, Visa, and Mastercard.
Digital Payments: Apple Pay and Google Pay.
3.3 Nap York does not accept cash and does not offer cash refunds. Any account credits are at our discretion.
3.4 The Charges will be provided by Nap York at the time of the booking request and are subject to applicable State and City taxes.
3.5 Unless otherwise stated by Nap York, the Charges include only the cost of accommodation at the Sleep Station.
3.6 Guests will be notified of any Additional Charges before they are applied. Any Additional Charges incurred during the stay must be settled immediately. These charges may include, but are not limited to:
Early check-in or late check-out fees.
Fees for damages, excessive cleaning, or missing items.
Charges for any optional services or amenities used during the stay.
3.7 For non-refundable rates, the total payment will be charged at the time of booking and is not eligible for a refund.
3.8 For standard or flexible rates, the balance of the Charges will be automatically charged 5 days before arrival using the card provided at the time of booking.
3.9 By booking with Nap York, Guests authorize Nap York to place a hold on their payment method for a damage deposit. The damage deposit hold will be placed at the time of check-in and released after check-out, subject to the following conditions:
No damages to property or furnishings.
No excessive cleaning is required.
All rules were adhered to during the stay.
3.10 The hold will be released within 7 business days after check-out. The exact time frame for the release may vary depending on the financial institution.
3.11 If deductions are made from the damage deposit hold, Guests will receive a written notification with an itemized list of charges.
3.12 If the damage or charges exceed the amount of the hold, Guest will be responsible for paying the additional amount. Failure to settle these charges may result in further action, including legal proceedings.
4. REFUNDS AND CANCELLATIONS
4.1 Nightly Reservations:
Non-refundable Rate: No refunds under any circumstances.
Refundable/Standard/Flexible Rate: Cancellations made within the allowed cancellation period (5 days before check-in) will receive a full refund.
4.2 Hourly Reservations:
Guests may cancel their reservation up to 2 hours before the scheduled check-in time to receive a full refund.
Cancellations made within 2 hours of the scheduled check-in time or after check-in time will not be eligible for a refund.
4.3 If the Guest fails to give sufficient notice of cancellation or fails to arrive (no show) at Nap York, the entire Booking will be deemed cancelled and the Guest will have to pay the full amount of the stay.
4.4 Refunds are not provided for early check-outs unless explicitly stated in the booking terms. Exceptions may be considered in cases where the early departure is due to an issue with the service provided, subject to management review and approval.
4.5 The final refund decision rests with the hotel unless otherwise mandated by law or third-party payment provider rules.
4.6 Refunds are processed to the original payment method used during booking. If this is not possible, alternative arrangements will be made upon agreement with the guest.
4.7 Refunds will be processed within 5 business days of the cancellation approval. Processing times may vary depending on the guest’s bank or payment provider.
4.8 In cases of force majeure (e.g., natural disasters, government-mandated travel restrictions, pandemics), Nap York may offer:
A full refund,
A partial refund, or
A credit voucher for future stays, valid for 6 months.
4.9 Nap York may at any time cancel the Booking if the payment details provided by the Guest are invalid and the Guest fails to provide alternative valid details.
4.10 Nap York may at any time cancel a Booking if the room becomes unavailable due to circumstances outside Nap York’s control in which case Nap York will offer the Guest the option to rebook for the future at no additional charge.
4.11 If a discounted rate is offered with a non-refundable condition, and the Guest has been informed, the full Charges will remain payable if the booking is canceled or modified.
5. DISPUTES AND CHARGEBACKS
5.1 Guests are encouraged to resolve any payment disputes directly with Nap York by contacting reservationsmanager@napyork.com. Nap York will make reasonable efforts to investigate and resolve disputes within 2 business days.
5.2 Guests must notify Nap York of any concerns or issues with charges prior to initiating a chargeback with their bank. Failure to do so may result in additional fees or denial of future bookings.
5.3 Nap York reserves the right to provide evidence to the payment provider to dispute any unauthorized or unjustified chargebacks. Evidence may include:
Signed registration forms or check-in documents.
Proof of service (e.g., invoices, receipts, reservation confirmations).
Communication records with the guest.
5.4 Any fraudulent chargebacks or disputes will be reported to relevant authorities.
6. CHECK IN AND CHECK OUT
6.1 Nightly Reservations
Check-In: Standard check-in time is 3:00 PM local time. Guests are expected to arrive at the premises no earlier than this time. Early check-in requests are subject to availability and may incur additional fees.
Check-Out: Standard check-out time is 10:00 AM local time. Guests must leave the premises by this time. A 30-minute grace period may be granted at management's discretion, after which extra charges will apply.
Overstay Charges: Late check-outs are subject to availability and must be arranged in advance. Staying past 10:00 AM without prior approval will result in additional fees, including an hourly rate or a surcharge if the overstay affects other reservations.
6.2 Hourly Reservations
Check-In Time: Check-in starts at the reserved hourly period. Guests will not be allowed entry before their reservation time. Failure to check in within the first hour without notifying may result in the reservation being forfeited without a refund.
Check-Out Time: Check-out is at the end of the reserved hourly period. Guests must leave by this time to avoid additional charges. A 15-minute grace period may be granted at management's discretion, after which extra charges will apply.
Overstay Charges: Staying beyond the reserved time without prior approval will result in additional fees, including an hourly rate or a surcharge if the overstay affects other reservations.
6.3 Guests are required to follow these steps during check-in:
Present valid identification in the form of a Driver License or Passport upon check-in. Failure to provide the necessary documents may result in denied access to the premises.
Review, acknowledge, and sign Nap York’s Terms & Conditions and property guidelines.
Pay any remaining balance, including security deposits or additional charges.
6.4 Guests are required to follow these steps during check-out:
Thoroughly check the space, including pods, lockers, and common areas, to ensure all personal belongings are collected before departure.
Ensure that all linens, towels and any other items provided by Nap York are returned to their designated location. Failure to return these items may result in additional charges.
Vacate the Sleep Station by the designated check-out time.
7. ACCESSIBILITY POLICY
7.1 Nap York is committed to providing equal access and a comfortable stay for all guests, including those with disabilities.
7.2 Guests with specific needs are encouraged to contact Nap York in advance by emailing reserve@napyork.com to confirm the availability of necessary facilities. Nap York will make reasonable efforts to accommodate all requests, subject to availability and feasibility.
7.3 If Nap York cannot meet a guest’s specific accessibility needs, the guest will be notified at the time of booking or inquiry.
7.4 Due to the nature of certain properties, some areas may have structural or historical limitations that restrict accessibility. In such cases, reasonable alternatives will be offered where possible.
7.5 Service animals accompanying guests with disabilities are welcome in all areas of Nap York where guests are allowed. Service animals are defined as dogs trained to perform specific tasks directly related to an individual's disability.
7.5.1 Guests with service animals are responsible for:
Supervising their service animal at all times.
Ensuring the service animal is well-behaved and under control (e.g., leashed, harnessed, or tethered unless these interfere with the animal’s tasks).
Cleaning up after the service animal.
7.5.2 Service animals must not:
Pose a direct threat to the health or safety of others.
Exhibit aggressive or disruptive behavior (e.g., barking excessively, jumping on people).
7.5.3 If a service animal is out of control and the handler does not take effective action to control it, Nap York reserves the right to request the removal of the animal
7.5.4 Nap York reserves the right to charge for damages caused by a service animal, consistent with the charges for damages caused by guests.
7.6 Emotional Support Animals (ESAs) are not considered service animals under the ADA and are not permitted in areas restricted to service animals only.
8. SLEEP STATION RULES
8.1 Quiet hours are in effect 24/7. Guests are expected to maintain a low noise level at all times to ensure a peaceful environment for all. Activities that create excessive noise, such as loud music, shouting, or disruptive behavior, are strictly prohibited both indoors and outdoors. Non-compliance may result in immediate action, including but not limited to, warnings, fines, and possible termination of the reservation without a refund.
8.2 Smoking, the consumption of alcohol, and the use of illegal drugs are strictly prohibited across all areas of the premises, including indoor spaces, outdoor spaces, balconies, and common areas. Violations of this policy may result in fines, eviction, forfeiture of security deposits or payments made, and additional cleaning fees to address odors or other related issues.
8.3 Nap York does not accept bookings made by those under the age of 18. Failure to adhere to this rule will result in automatic Cancellation with no refund given.
8.4 All pods are strictly single occupancy. Any attempt to accommodate additional guests without prior authorization may lead to fines, eviction, and forfeiture of security deposits.
8.5 Guests are required to conduct themselves in a reasonable and responsible manner at Nap York and must not act in any way which may disturb other guests.
8.6 Pets of any kind are not allowed. Specific policies for service animals apply.
8.7 Storing or consuming food inside the room is strictly prohibited. This rule applies to all types of food and beverages, except for water. Guests are required to consume all food and beverages in designated eating areas provided by the property.
8.8 Nap York does not accept mail, packages, or deliveries on behalf of guests. Any items sent to the premises will be refused or returned to the sender. Guests are responsible for arranging alternate delivery options during their stay.
9. PROHIBITION OF ADDRESS CHANGE TO NAP YORK PREMISES
9.1 Guests are prohibited from using Nap York’s address as their personal or business address for any official or legal purposes.
9.2 Nap York does not permit the use of its address for the registration of personal identification documents, mail correspondence, or any official purposes. Any breach of this condition may result in the cancellation of the booking, and guests may be required to vacate the premises immediately.
10. LIABILITY
10.1 Nothing in these Conditions purports to limit or exclude the Nap York’s liability for:
Death or personal injury caused by the negligence of Nap York, its employees, subcontractors or agents.
Fraud or fraudulent misrepresentation.
Any other matter for which it would be illegal for the Sleep Station to limit or exclude its liability.
10.2 Nap York is not liable for injuries, accidents, or health-related issues occurring on the premises unless directly caused by negligence or failure to meet legal safety standards. Guests are advised to exercise caution and act responsibly while on the premises.
10.3 Guests are solely responsible for their personal belongings during their stay. Nap York is not liable for the loss, theft, or damage of any personal items, including items stored in lockers or left in common areas. Guests are encouraged to secure valuables and use available storage facilities.
10.4 Nap York shall not be held liable for any failure or delay in providing accommodations or services due to causes beyond its reasonable control, including but not limited to natural disasters, government actions, labor strikes, pandemics, or power outages.
10.5 Nap York is not liable for temporary disruptions to facilities or services, such as water, electricity, or internet, caused by maintenance, technical issues, or external factors. Efforts will be made to restore services promptly.
10.6 Nap York is not responsible for the quality or safety of services provided by third parties, including transportation, tours, or other activities booked through external vendors.
10.7 Guests are liable for any harm or disruption caused to other guests, staff, or the premises due to their actions. Nap York reserves the right to terminate a reservation without a refund if a guest’s behavior violates policies or poses a risk to safety or property.
10.8 Guests are responsible for adhering to all local laws and regulations while on the premises. Nap York disclaims liability for any penalties, fines, or consequences resulting from a guest’s illegal activities.
10.9 Guests agrees that Nap York is only supplying its facilities, products and services to the Guest for private use and have no liability to the Guest for any loss of profit, loss of business, business interruption or loss of business opportunity.
11. PERSONAL DATA
11.1 Nap York’s treatment of Guests data follows the US General Data Protection Regulations.
11.2 The Guest hereby consents to Nap York collecting of the Guests personal data such as name, surname, email address, social security number, phone number, address, contact information, details of the bank account number and IP number.
11.3 The personal data is used by Nap York for the performance of the Contract, for marketing and as a basis for statistics and for Nap York’s product development. Nap York has the right to share your personal data with its partners for advertisement and promotion.
11.4 The personal data may be analyzed and grouped for the selection, prioritization and planning of the marketing of Nap York, so-called profiling.
11.5 As a Guest of Nap York, you agree to receive marketing information via mail, telephone, or e-mail and text messages, and other digital channels.
11.6 Personal information is disclosed to US authorities only when it is required by law or official order.
12. GENERAL
12.1 The Guest’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Conditions.
12.2 Nap York may transfer its rights and obligations under the Contract to another organization but will always inform the Guest if this happens and this will not affect the Guest’s rights under the contract.
12.3 Nap York may, from time to time, change these Conditions without notice. Guests are advised to check Nap York’s website for the latest version of these Conditions before making a Booking.
12.4 No failure by Nap York to enforce these Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.
12.7 If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
12.8 These Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of New York State will have jurisdiction to deal with any disputes (including in relation to non-contractual matters) arising in connection with it.
12.9 No person who is not a party to the Contract will have any rights in connection with it.
By making a reservation, Guests acknowledge and agree to adhere to all clauses outlined above.
